Pre-litigation infringement and invalidity assessments. The analytical methods are those that support trial-ready claim charts and invalidity contentions, calibrated to the decision in front of the client rather than to the courtroom. Used to evaluate whether to assert claims, whether to defend against an assertion, or whether to license. The deliverable informs the actual monetization decision and, where a matter later escalates, can be carried forward into litigation.

Source Code Review and Reverse Engineering

Pre-litigation technical analysis of competing or target products: code comparison, architecture recovery, binary and protocol reverse engineering, and runtime instrumentation. Used for infringement evaluation, code-provenance assessment in trade-secret matters, licensing-negotiation support, and M&A and audit-clause diligence. The work is documented to the standard that supports the same analysis in litigation, with the chain of evidence preserved so each finding traces back to the artifact it rests on.

IP Licensing Support

Technical analytical support for licensing negotiations, inbound and outbound. The work includes claim charts calibrated to negotiation stage, technical infringement reads, invalidity-exposure analysis, royalty-base analysis with apportionment to the smallest salable patent-practicing unit, cross-licensing and counter-assertion analysis where the holder operates in the counterparty’s product market, and standards-essential / FRAND work for SSO-disclosed patents.

How We Work

An engagement begins with a scoping conversation that defines the question and identifies the artifacts to be examined. Cyberonix then conducts a targeted review of the relevant material: claims, specifications, prosecution histories, accused-product artifacts, prior-art patents and publications, product documentation, and where access permits, source code. Where the target code is not available, reverse engineering recovers the behavior, architecture, and protocol-level interface of the accused or target product from the artifacts that are accessible. The output is written analysis calibrated to the IP-monetization decision the client is making.

The deliverable is written analysis for counsel and IP holders, not expert reports or sworn testimony. Engagement length ranges from short single-claim or single-target reads (used by counsel to set an initial licensing posture or to decide whether to escalate) through multi-month portfolio analyses supporting a full assertion or licensing program. Where a matter later proceeds to litigation, the same analytical record can be carried forward by the firm’s litigation practice, so the work done at the monetization stage is not redone when the matter reaches the courtroom.
