Cyberonix is a software expert witness consulting firm founded in 2013. Across the firm, our consultants have served on more than 150 litigation matters, prepared more than 250 expert reports and declarations, provided sworn testimony in more than 50 depositions and trials, and accumulated more than 50 years of combined experience in software engineering practice and research.
Cyberonix applies the analytical rigor of academic computer-science research to the technical questions at the center of high-stakes software disputes: how a system was built, what its source code does, whether it infringes a patent, whether it embodies misappropriated trade secrets, and whether it was delivered in conformance with what the parties agreed. The same analytical discipline is brought to pre-litigation work in intellectual-property monetization and to advisory engagements with technology and corporate leadership on questions of software architecture, engineering practice, and AI and technology due diligence.
What We Do
Attorneys retain Cyberonix to produce the technical analysis and testimony required to prosecute or defend software-related disputes. Our deliverables include source code analysis and inspection support, expert reports and rebuttal reports, technical declarations, deposition and trial testimony, and pre-litigation advisory consulting on the technical merits of a contemplated matter. The form an engagement takes depends on the procedural posture of the case and the questions counsel needs answered, and we tailor the scope of our work accordingly.
Cyberonix is retained on patent infringement and invalidity matters, trade secret misappropriation claims, copyright disputes, breach of contract and software project failure cases, and class action lawsuits involving software systems. Engagements range from short technical assessments (used by counsel to evaluate the strength of a claim or defense before committing to it) through full preparation of expert reports and trial testimony in matters that proceed to litigation.
Outside of litigation, Cyberonix is retained for two related categories of work. In pre-litigation matters, the firm analyzes patent portfolios, prepares infringement and invalidity assessments, and supports IP licensing decisions. In advisory engagements with technology and corporate leadership, the firm provides independent technical assessments of software systems and engineering practices, evaluates AI systems for bias and governance risk, and conducts technology due diligence in connection with mergers, acquisitions, and investments.
How We Work
Cyberonix’s analytical approach combines automated tooling with manual review by experienced engineers. Automated tools (including static analysis platforms, dynamic analysis instrumentation, code-search and code-comparison utilities, and architecture-recovery software) make it tractable to examine codebases that would otherwise be too large to review in detail. Their output, however, requires expert interpretation to be admissible and persuasive: tools surface candidates for further review, and the manual layer is where a software expert witness establishes which findings are material to the disputed questions and which are noise.
Source code is one input among several. Our analysis considers the broader record of how a software system was built and operated: requirements documents and specifications, version control history, code review records, defect trackers, build and deployment logs, test results, and design and architecture artifacts.
Different disputes draw on different parts of that record. In trade secret matters, version control history and commit metadata help establish the provenance of code segments alleged to have been copied, while code-comparison utilities surface textually and structurally similar passages for expert review. In patent disputes, architecture-recovery output produces a structural view of an accused system that can be compared directly against the claim elements at issue. In breach of contract and failed-project matters, requirements documents, test records, and defect trackers together frame what was agreed, what was delivered, and what was left unresolved.
Establishing what the available evidence supports, and equally important what it does not support, is the analytical core of the work, and it is what distinguishes a defensible expert opinion from a conclusion that will not survive cross-examination.
Cyberonix documents its methodology and reasoning at a level intended to withstand scrutiny by opposing experts and the court, consistent with the documentation discipline expected in peer-reviewed research. Our opinions are tied to the specific record of the case, stated in terms of what the underlying artifacts support, and traceable to the evidence on which they rely. This standard reflects the academic backgrounds of our consultants, who carry into their software expert witness work the analytical discipline of the research environments in which they were trained.
Our Experts
The Cyberonix team is a small group of senior consultants, each holding a faculty appointment at a research university in the United States and each with extensive industry experience in software engineering, software architecture, software security, or artificial intelligence systems. The team’s standing in the field is reflected in recognitions including IEEE Fellow status, ACM Distinguished Member status, and named professorships at leading research institutions. Engagements are staffed so that the lead consultant’s research record and industry background align with the technical questions in the case, allowing the firm to bring directly relevant subject-matter depth to each matter. When a dispute spans multiple technical domains, as patent and class-action matters frequently do, more than one consultant may be assigned, with roles allocated by subject area. As the firm’s engagement load grows, Cyberonix is also building out a team of salaried consultants who support and extend the senior experts’ work across both litigation and advisory engagements.
